Terms of Service

These Terms of Service ("Terms") govern your use of the Caption Plug website at https://www.captionplug.com (the "Site") and your purchase of the Caption Plugsoftware (the "Software"). By creating an account, making a purchase, or using the Site, you agree to these Terms. The Software itself is licensed under the separate End User License Agreement.

1. Who we are

2. Accounts

• You must provide a valid email address and keep your password confidential.
• You are responsible for activity that happens under your account.
• You must be at least 16 years old (or the age of digital consent where you live).
• We may suspend or terminate accounts that abuse the Site, attempt to circumvent purchase or license controls, or violate these Terms.

3. Purchases

• The Software is sold as a one-time purchase of $8.99 USD (plus any applicable taxes). It is not a subscription; there are no recurring charges.
• Payments are processed by Stripe. We never see or store your card number. Stripe's own terms and privacy policy apply to the payment itself.
• A purchase entitles the account that made it to: the Software download, a personal license key, activation on up to 3 machines you own, and all v1.x updates.
• Prices may change for future buyers; your completed purchase is never re-billed.
• Refunds are handled per the Refund Policy.

4. Acceptable use of the Site

• No attempting to access other users' accounts, purchases, or license keys.
• No scraping, probing, load-testing, or attempting to bypass rate limits, signed download URLs, or other security measures.
• No sharing, reselling, or publishing license keys or download links.
• No using the Site to distribute malware or unlawful content.

5. Intellectual property

The Site, the Software, the preset animations, and the Caption Plug brand are owned by us. The 62 bundled caption fonts are third-party open-source fonts under their own licenses (SIL OFL / Apache), which permit commercial use and are included with the Software. Captions and videos you create with the Software are yours.

6. Third-party services

The Software connects to transcription providers (OpenAI or Groq) using your own API key, under your agreement with that provider. We are not a party to that relationship and are not responsible for those services, their pricing, or their availability. Adobe Premiere Pro is a product of Adobe Inc.; we are not affiliated with Adobe or CapCut.

7. Disclaimers

The Site and Software are provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that transcription will be error-free (it depends on third-party models), that the auto-censor will catch every word you'd want caught, or that the Software fits every Premiere Pro configuration. Nothing in these Terms excludes liability that cannot be excluded by law, and statutory consumer rights remain unaffected.

8. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or relating to the Site or Software is limited to the amount you paid us ($8.99). We are not liable for indirect, incidental, special, or consequential damages, including lost profits, lost content, or demonetization decisions made by third-party platforms.

9. Changes

We may update these Terms; material changes will be flagged on this page with a new "last updated" date. Continuing to use the Site after changes take effect means you accept the updated Terms.

10. Governing law

These Terms are governed by the laws of [YOUR JURISDICTION], excluding its conflict-of-law rules. Courts of [YOUR JURISDICTION] have exclusive jurisdiction, except where mandatory consumer law gives you the right to sue at home.
